A lot of people have been asking us about the rumor that Trump will invoke the Insurrection Act on April 20th. We want to remind everyone to take things one day at a time and face each battle as it comes.
Here’s why this date is being discussed:
Answer: When Trump took office on January 20th, one of his first executive orders was titled “Declaring a National Emergency at the Southern Border of the United States.” In it, he stated:
“A national emergency exists at the southern border of the United States… I hereby declare that this national emergency requires use of the Armed Forces…”
This order directed the Secretary of Defense and the Secretary of Homeland Security to submit a joint report to the President within 90 days, evaluating whether the Insurrection Act of 1807 should be invoked.
For context: The Posse Comitatus Act of 1878 typically prohibits the use of the military as domestic law enforcement. However, the Insurrection Act of 1807 provides the President with the authority to deploy the military within the U.S. during situations of rebellion, insurrection, or civil disorder.
